Please read this End-User Licence Agreement (“EULA”) carefully before using your device and downloading the software updates that are given with this licence. By using your device or downloading the software updates, you agree to adhere to the terms of this licence. If you do not accept the terms of this licence, do not use this device or download the software update.
Applications that are presented by General Mobile and Google Play Store, feature improvements in read-only storage or in another setting or style that are provided by General Mobile, software updates or softwares that are given with your phone as updated or changed by system restoration softwares ( including Boot ROM code, embedded software and third party softwares), documents, interfaces, contents, fonts and all kinds of data are not sold to you, but they are only licenced to you in order to be used only according to the terms of the hereby Licence. Those who give licence to General Mobile possess the property of the software and hide all rights that are not openly given to you. Terms of this Licence will be valid for all applications that are branded General Mobile and Google. If such an application is given with a separate licence, this licence will be able to administer your use of the application. General Mobile, depending on its own discretion, may bring out software updates in the future. When General Mobile Software Updates are out, they do not have to include all of the existing software features or features that General Mobile have put forth for newer or other device models. As long as the software update that is provided by General Mobile is not accompanied by another licence, provisions of the hereby licence is applied to the software updates as well. If there is a separate licence that accompany the General Mobile Software Update, provisions of that licence are applied.
Liable to the provisions and terms of the hereby Licence, you are provided a limited and unexclusive licence for you to use the General Mobile Software on a single device of General Mobile. Hereby Licence does not give you the right to use the interfaces and intellectual property rights of General Mobile to be used on devices for third party devices and their accessories or for designing, developing, producing, sharing or distributing third party software applications or for giving their licence. Some of these rights can be obtained from General Mobile with separate licences.
Other than the terms that are clearly permitted in this Licence, you can not copy, transform into source code, reverse engineer, break into pieces, try to reproduce the source code or decrypt General Mobile Software or other services that are provided by General Mobile Software, or any part of these services, and you can not create reproduced gears. You accept that you will not perform such actions or enable others to perform them as well. You accept that you can not delete, hide or change any property statements that are added to General Mobile Software, or statements that may be in this software (including trademark and copyright statements). Trademark and intellectual rights of all content that is viewed or reached by your device or stored in your device belongs to the owners of the relevant content. These contents may be protected by copyright or other intellectual property laws and contracts and may be liable to provisions of the third party that provide these types of contents. Unless hereby document states otherwise, hereby Licence does not allow you to use such a content and does not guarantee that such a content will continue to be provided to you.
You accept that you will use General Mobile Software and Services suitably to all laws that are applied, including local laws of the country or the region where you live or have downloaded General Mobile Software and Services in. Features of General Mobile Software and Services may not be used in all languages or regions, some features may vary depending on the country and some may be limited or blocked by your provider.Wi-Fi or cellular data connection is necessary for some features of General Mobile Software and Services.
You accept that many features, situated practices and Services of General Mobile Software may perform data transmission and may cause you to be priced and that you will be responsible for these sorts of payments. You can view and check which applications are allowed to use mobile data from your Mobile Data settings.
If you choose to allow automatic application updates, your device will regulary check from General Mobile whether there are any updates for the devices in your applications and if there is an update, it will be automatically downloaded and installed. You can go to Settings and turn off automatic application updates whenever you want.
You can not rent, lend, sell, redistribute General Mobile Software, or give out its sub-licence. In addition to this, you can transfer all of your General Mobile Software’s rights for one time only in these terms, in conjunction with the transfer of title of your device:
General Mobile Software may provide you reach to Google Play Store and other General Mobile and third party services and websites. Use of these services require internet access and usage of certain services may require Google identity and accepting additional terms and additional payments may also be applied.
Specific services may view, contain or keep avaible the content, data, information or materials of the third parties, and may give links for specific third party websites. By using services, you agree and accept that General Mobile is not responsible for analyzing or evaluating the content, accuracy, inactness, currency, validity, suitability to copyrights, legality, honesty, quality or other aspects of such materials of third parties. General Mobile, its employees, its subsidiaries and third party services of its affiliates or websites or other materials of third parties do not guarantee or support the products or their services, take no responsibility and have no liability or responsibility.
General Mobile and any of its content providers do not guarantee the utility, accuracy, inactness, reliability and promptitude of the finance information, data related to location determination and other data that is displayed by any of the services.
In case you upload any content by using Services, you declare that you hold all the rights about the subject content or that you have the authority to upload the content or that you are legally permitted and that the subject content does not violate any term of service usage regarding Services. You accept that Services includes special content, information and materials that are owned by General Mobile, site owner or by those who give licence to them and that it is protected by applied property rights and other laws (included but not limited to copyright). You agree that you will not use the subject special content, information or materials in a way other than the permitted purpose which is the usage of Service, or in a way that is in odds with the provisions of the hereby Licence or violates General Mobile’s intellectual property rights.
No part of the Services can be reproduced in any form or condition, services can not be changed, leased, lent, sold, distributed or action derived from the usage of services can not be created. Services can not be used in an unpermitted way, including but not limited to sending any type of computer virus, worm, trojan horse or another ill intended software and violating network capacity.
General Mobile and those who give licence to General Mobile withhold the right to change, stop, remove any Service and take back its access authorization at any time, without any advance notice. In no condition will General Mobile be responsible for the removal of any of the services or the withdrawal of its access authorization. General Mobile may also put limitations on the usage of specific Services or on their access without advance notice or any responsibility.
This Licence will remain in force until it is repealed. In the condition that you disobey the terms of the hereby Licence, your rights in the hereby Licence will automatically end and in other words expire their validity, without the need of any denunciation by General Mobile. After the termination of the hereby Licence you must stop all use of General Mobile Software. Provisions of the hereby Licence about the extent and limitations of usage will remain in force unaffected by the termination.
You openly agree and accept that you use General Mobile Software, and any service that is performed or reached by this software, in a way that is permitted by the law and that only puts yourself at risk, and that all the risk regarding satisfactory quality, performance, truthfulness and effort belongs to yourself.
At maximum level that is permitted by statues at large, General Mobile Software and Services are given with all of their defects and without any guarantee, and with the hereby document, General Mobile and those who give licence to General Mobile do not accept any open, implicate or legal guarantees and provisions, which are included but not limited to salability regarding software and services, satisfactory quality, fitness to a specific purpose, faultlessness, ownership, implicate guarantees and/or conditions regarding not violating third party rights.
General Mobile does not guarantee that your use of its software and services will not be interfened, that the functions of the software or services that are executed or provided will meet your needs, that its software and services will run uninterrupted, that services will continue to be usable, that defacts of its software and services will be fixed, that its software will correspond to third party softwares, applications or third party services or that it will work together with them. Downloading this General Mobile software may affect the availability and utility of third party softwares, applications or services along with General Mobile products and services.
Verbal or written information or suggestions that are given by General Mobile or an agent that is authorized by General Mobile do not constitute a guarantee. In the condition that the legal legislation does not permit implicate guarantees to be excluded from the contract or legal rights in effect to be limited, exclusions or limitations above may not be applied to you.
In the measure that is allowed within the limitations of the law in effect, and even if the possibility of the subject damages are notified to General Mobile, General Mobile, its subsidiaries, its agents, or those who are responsible for it will not be responsible (according to the responsibility presupposition) in any condition for any accidental, special, indirect, and in a word, any damages or injuries that are caused by your use (or by your inability to use) its software, services or any third party software, application or service with its softwares and services or from other issues, including (but not limiting to) a related profit loss, data loss or deterioration, inability to transmit or receive any data, interruption of work, other trading losses and casualties, regardless of when and how they happen. Some country laws do not allow for the exemption or limitation of responsibility for personal injuries or accidental or eventual damage; in this case this limitation may not be applied to you.
General Mobile Software includes a function that allows for the acceptance of digital certificates that are given by General Mobile or third parties. It is only in your responsibility to trust or distrust a digital certificate that is given by General Mobile or by a third party. The risk that comes with the usage of digital certificates is only up to you. In the maximum level that is allowed by the statues at large; General Mobile can not undertake (or inform about) the salability of digital certificates or their fitness to a specific purpose or their obedience to the third parties’ rights.
Other than the conditions when the laws of the country where General Mobile Software is procured, you can not use General Mobile Software or export it in another form or reexport it. You accept that you will not use General Mobile Software for any purpose that is forbidden by the laws of the country you are located in, including but not limited to the developement, design, manufacturing or production of rockets and nuclear, chemical and biological weapons.
Hereby Licence is liable to Turkish law, except for the principle of conflict of laws, it will be interpreted in the direction of the laws of The Republic of Turkey. Istanbul Regional Courts of Justice and Enforcement Offices are authorized for the discrepancies that are born out of the hereby agreement.
Hereby Licence forms the wholeness of the agreement between you and General Mobile that is related to General Mobile Software and substitutes all previous or simultaneous agreements about the subject matter.Unless it is written and signed by General Mobile, any modification or change on the Licence will be non-binding.
Specific parts of General Mobile Software may include third party softwares and may use or include other materials that have copyright. Confirmation, licence terms and disclaimer of the subject materials take place in electronic files of General Mobile Software and your use of the subject material is contingent upon their own terms. Use of Google Security Web Scanner is contingent upon Google Service Terms and Google Privacy Policy
